掉在施工的坑里受到损害怎么办

在公共场所、道旁或者通道上挖坑、修缮安装地下设施的，应当设置明显标志和采取安全措施。但现实中有些施工场所没有设置明显标志和采取安全措施，以致造成他人损害，如行人夜晚掉在施工的坑里就屡见不鲜，受害人该向谁请求赔偿呢？依照《民法通则》125条规定，施工人应当承担民事责任。这里应当注意的是施工人并非发包方，在有些单位施工的情况下，承担责任者也不是从事施工的工人个人，而是其所在的法人单位或其他组织。
