委托合同与雇佣合同区别

委托合同与雇佣合同都是提供劳务或服务的合同，这是两者之间的相同点。两者之间的差别在于：
　　1、在雇佣合同中，受雇佣的人提供劳务或服务，必须严格按照雇主的要求；而委托合同中，受托人有自己的主动权，并可以自己的名义，发挥主观能动性，完成委托事务。
　　2、在雇佣合同中，完成的劳务是确定的；而委托合同中，委托事务是确定的，受托人如何去完成，具有一定的酌情处理权。
　　3、雇佣合同肯定是有偿合同；而委托合同既可是有偿的，也可是无偿的。
